Hello everyone. I am going to appear for my CA Final exams in May, 2013. I want to go for Industrial Training during the last year of my Articleship (Last year: October 26, 2012 to October 25 , 2013). However, I have the following doubts in this regard.

(i) How many months will they give leave for my CA Final exams?

(ii) How will be the working hours (I know that it depends on the company; but please tell in general)?

(iii) Will they allow me to undergo GMCS durning my Industrial Training?

I will be really grateful to you if you clarify the above questions.

Thanks in advance

I don't understand what exactly you mean by that. Please clarify as to what do you mean by that.

Hi

Industrial training is a training scheme by which a student can undergo practical training within an industrial undertaking having specified amount of fixed assets or turnover or paid-up share capital. Industrial training can be commenced during the last one year of articleship. Industrial training can be performed in financial, commercial, industrial undertakings with minimum fixed assets of Rs.1 crore; or minimum total turnover of Rs. 10 crore; or minimum paid–up share capital of Rs. 50 lakhs; or such other institutions or organization as may be approved by the Council from time to time. The period of industrial training may range between 9 months and one year. The industrial training shall be received under the member of the Institute. An associate who has been a member for a continuous period of at least 3 years shall be entitled to train one industrial trainee at a time and a fellow shall be entitled to train two industrial trainees at a time. There should be an agreement of industrial training in Form No.104. On satisfactory completion of industrial training by an articled/audit assistant, the associate/fellow member under whom the industrial training is received shall issue a certificate in Form No.105 in respect of the training undergone. It is required to maintain details of work undertaken and training received in the prescribed format. For Industrial training time period is not specified it will depend on working hour schedule where you are doing articleship.

Is it possible to get 2 months leave in industrial training i.e., from March 1st for May Exams?

Hi

1. LEAVE

A trainee earns leave at the rate of one–sixth of the period actually served by him. Leave due is ordinarily granted, if reasonable notice has been given by the trainee to his MIT / Principal.

in order to prepare for the examinations of the Institute, a trainee is granted leave for a period of 2 months or to the extend of leave due, whichever is less. However, the trainee should make an application for such leave at least 15 days in advance. The days on which a trainee appears for the examination conducted by the Institute (including intervening holidays) are counted as a period on duty.

2. WORKING HOURS

Regulation 51 talking about Industrial Training such regulation not specified working hour of trainee doing industrial training. Regulation 60 deal with working hour of an article assistant which says that the minimum working hours of an articled assistant shall be 35 hours per week (excluding lunch break) which shall be regulated by the Principal from time to time, subject to such directions and guidelines, as may be issued by the Council. In details about working hour is here under:

i. The working hours for the articled assistants shall be 35 hours in a week, excluding the lunch break.

ii. The office hours of the Principal for providing articled training to the articled assistants shall not generally be before 9.00 A.M. or after 7.00 P.M.

iii. The normal working hours for the articled assistants shall not start after 11.00 A.M. or end before 5.00 P.M.

iv. The working hours for the articled assistants should not exceed 35 hours in a week excluding the lunch break and normally an articled assistant be required to work during the normal working hours fixed for articled assistants.

v. In case of the exigencies of work, an articled assistant may be required to work beyond his/her normal working hours. However, under such circumstances, the aggregate number of working hours shall not exceed 45 hours per week. The requirement to work beyond 35 hours in a week should not be a practice but only in exceptional circumstances. Further, where the articled assistant is required to work beyond normal working hours, and aggregate of such hours exceed 35 hours per week, he/she shall be entitled to compensatory leave calculated with reference to number of completed working hours, over and above, 35 hours per week.

3. GMCS ELIGIBILITY

A student who has passed Intermediate / Professional Education (Examination – II) / Professional Competence Course and is serving his last 12 months of articles is eligible to complete the course. The requirement of compulsory attendance in this course applies to all the Articled/ Audit Assistants:

A student after being declared successful in the Final Examination under old or new scheme can be admitted as an associate member only after completion of the course on General Management and Communication Skills

A student who completes Three Months’ Residential Programme in General Management, Personality Development and Communication Skills organized by the Board of Studies will not be required to undergo GMCS Course.

I think you resolve your queries on the basis of above and if you are not satisfy with contact with near institute for the same.
