I want to convert a existing partnership into LLP. I want to continue with the name of the existing partnership firm but someone has already registered the trademark of same so in this case is there any possibilty of reservation of name if we dont want to change the name as the existing partnership firm is carrying on the business under the name from many years and doesnt wants to change it..??

Name of the LLP shall not be
1) Identical with the name of the existing LLP/Firm/Body Corporate
2) Undesirable in opinion of Central Government
3) Prohibited under the Emblems and names prevention of improper use act
4) Identical or similar with registered or pending trademark under the trade mark act.
In this case it's not possible to continue with the same name since its already registered for trademark.
So you have to suggest other name which is not identical with other entities or trademark.
