Claiming HRA and Medical allowance not declared in Form16

Hi all,

For the FY 2010-11, I worked in two companies.

From Apr10-Jun10 in one company and from Jun10-mar11 in another.

Now I have two form 16 with me.

The problem is my first company didn't mention anything about HRA and Medical Allowance in the from 16 since they use to collect all proofs towards the end of FY.

Since I had left way before they collect the proof, they have not shown any HRA and medical exemption in the Form 16.

Also they haven't deducted any tax since my salary for 2 months didn't fall in the taxable bracket.

My question is, can I claim the HRA and Medical allowance exemption while filing the ITR.

If yes, then please let me know the procedure to do so.

You can avail the benefit of HRA while filing your ITR, and will have to work out hte tax liability by adding the income as per 2 Form 16. There could be additional tax liability, as both the employers must have given you the benefit of miniimum amount not chargeable to tax..

Yes, even i am of the same view for HRA.

But what about medical reimbursent of INR 15K ?

yes there is no problem for claiming HRA and medical exemption.

there can be additional Tax liabilty of HRA.. but if you have proper proof of medical exemption you can take benefit..

What do you mean by additional Tax liability of HRA?

By 'proper proof of medical exemption' you mean medical bills for that period?

Also, while filling ITR form I will have to populate the details of Form 16 under the 'Tax Deducted at Source from Salary' for both employer.

Now since my first employer have not shown anything under HRA and medical exemption, the figure for the column 'Income chargeable under the head salary' in the Form 16 is something which is including the HRA and medical amount that should have been exempted.

Now if I calculate the HRA and medical exemption and fill the computed figure in the ITR form there will be a mismatch in the figures in the Form 16 and in the ITR. Will it not create any problem?
