Can a person appointed as Company secretary who's name has been removed from the Register of Member on the date of Appointment on the
basis of non payment of Annual Membership Fee?

YES.
Reason being on payment of unpaid FEE restoration of name will be with retrospective effect. However views of other members solicited.
In my view, it would not be correct to appoint him till he gets his name restorted in the register of members.
I agree with Ankur's view, coz its not that on payment of membership fees he will be admitted with retrospective effect and not from the date of payment of fees.
Dear All,
I agree with Mr. Ankur Garg, however Company can't file form 32 until restoration of CS membership with retrospective effect.
