Respected Members,

 

We have filed an appeal for Service tax matter in which we deposited the 10% of the Demand amount in advance. 

Appeal is decided in our favour. so What is the process to get the deposited amount back and what documents are required. 

Please help me.

✅ Process to Refund Appeal Deposit (Service Tax)

  1. Order in Your Favor: Since the appeal is decided in your favor, you’re eligible for a refund of the 10% deposit paid.

  2. File Refund Application:

    • Submit a refund claim to the concerned Commissioner (Appeals) / Appropriate Authority who decided the appeal.

    • Usually, this is done by filing Form TR-6 (Refund application for Service Tax).

  3. Attach Documents:

    • Copy of the Order/Judgment in your favor.

    • Proof of the deposit paid (challan or bank receipt).

    • Copy of the appeal memo or acknowledgement.

    • Letter/request addressed to the Commissioner for refund.

  4. Verification & Sanction:

    • The authority will verify the claim.

    • Upon verification, refund sanction order will be issued.

  5. Refund Credit:

    • The amount will be credited to your bank account (details usually provided in the refund application).

    • This may take some time depending on the department’s processing speed.
