What is the e-Dispute Resolution Scheme (e-DRS)?

The e-DRS is an innovative digital platform launched by the CBDT that allows taxpayers to electronically file an application for dispute resolution through designated Dispute Resolution Committees (DRC). These committees are specifically set up for different regions under the Principal Chief Commissioner of Income Tax to ensure disputes are resolved quickly and fairly.

How Does e-DRS Work?

Under the e-DRS, taxpayers can challenge a ‘specified order' as defined in Section 245MA of the Income Tax Act. This includes:

  • Orders with variations not exceeding Rs 10 lakh.
  • Returned income for the relevant assessment year not exceeding Rs 50 lakh.
  • Orders that are not based on searches, surveys, or information received under international agreements.

The DRC can modify the variations in the specified order and decide on the reduction or waiver of penalties and prosecutions in accordance with rule 44DAC of the Income-tax Rules, 1962.

  2. Submit on Time: Applications must be filed within one month from receiving the specified order. If an appeal is pending before the Commissioner of Income-tax (Appeals), the application for e-DRS must be filed by September 30, 2024.
  3. Additional Deadlines: For orders issued on or before August 31, 2024, and where the appeal time hasn't expired, applications must be submitted by September 30, 2024.
