CBIC Amends Customs Duty Exemptions for LRSAM Equipment

Last updated: 18 January 2025

In a move to strengthen India's defense capabilities, the Central Government has issued Notification G.S.R. 64(E), making further amendments to the Notification No. 19/2019-Customs, dated July 6, 2019. The amendment is aimed at providing specific exemptions for customs duties applicable to components of the Long Range Surface to Air Missile System (LRSAM).

This amendment, issued under the Customs Act, 1962 and the Customs Tariff Act, 1975, is effective immediately and highlights the government's continued focus on promoting indigenization and modernization of India's defense sector.

CBIC Amends Customs Duty Exemptions for LRSAM Equipment

Key Highlights of the Amendment

  1. Updated Scope of Exemptions:

    • The amendment replaces the existing item description under Serial No. 21, Column (3) of the original notification.
    • It now includes systems, sub-systems, equipment, parts, sub-parts, tools, test equipment, and software specifically meant for the Long Range Surface to Air Missile System (LRSAM).
  2. Focus on LRSAM:

    • The LRSAM, also known as Barak 8, is a state-of-the-art missile defense system developed through an India-Israel joint venture.
    • The exemption is expected to lower the cost of importing critical components, thus accelerating the deployment of this advanced defense technology.
  3. Immediate Effect:

    • The notification is applicable from the date of its publication, ensuring that businesses and defense suppliers can avail the benefits without delay.

Implications for the Defense Sector

This amendment aligns with the government’s push toward bolstering defense infrastructure while promoting cost efficiency. By reducing the financial burden on imports of critical components for LRSAM, the amendment fosters:

  • Operational Readiness: Ensures faster deployment of defense systems to enhance national security.
  • Indigenization Support: Complements the "Make in India" initiative by encouraging the use of imported parts for domestic manufacturing.
  • Cost Efficiency: Provides fiscal relief to manufacturers and suppliers engaged in defense production.

Conclusion

The government's proactive approach through this notification reflects its commitment to strengthening India's defense capabilities while supporting public-private collaborations in the sector.

Businesses involved in the production and supply of LRSAM components are encouraged to leverage this amendment for operational benefits. For further details and compliance requirements, consulting with a customs expert is advisable.
