Insurance Rules, 2026 to Replace 1939 Framework

According to the notification, the new rules will be known as the Insurance Rules, 2026 and will come into effect from the date of their publication in the Official Gazette. The move marks a significant update to a regulatory framework that has governed India's insurance industry for nearly nine decades.

Key Proposals in the Draft Rules

Greater Transparency in Insurance Products

The draft rules mandate that any prospectus, premium table, or insurance-related document supplied to prospective policyholders must clearly disclose:

  • The risks covered under the policy;
  • Eligible classes of persons or property;
  • Conditions for premium discounts; and
  • Statutory disclosures relating to insurance rebates.

The objective is to ensure that consumers receive complete and transparent information before purchasing insurance products.

Stricter Norms for Insurance Agents

The proposed framework also lays down conditions for recognizing an agent as an authorized insurance agent for the purposes of Section 41 of the Insurance Act. Among other requirements, agents must demonstrate a minimum level of business generation by securing policies across specified categories before qualifying under the provision.

Enhanced Governance for Insurance Councils

The draft rules prescribe responsibilities for members of Life Insurance and General Insurance Councils when executive committees are dissolved, including maintaining member records, supervising appointed officials, collecting prescribed fees, and assisting in conducting elections for new committees.

Rules on Shareholding and Beneficial Ownership

The proposal introduces updated disclosure requirements relating to ownership and beneficial interests in shares of insurance companies. Specific forms have been prescribed for declarations relating to share ownership and beneficial interests, strengthening transparency in insurer ownership structures.

Action Against Financially Distressed Insurers

The draft rules empower the regulator to suspend or cancel the registration of insurers found to be financially unsound based on actuarial valuation reports and statutory disclosures. The framework also provides mechanisms for revival, transfer of business, or liquidation where necessary.

Search and Seizure Framework Codified

One of the notable provisions in the draft rules relates to the exercise of search and seizure powers under Section 34H of the Insurance Act. The rules detail procedures regarding authorization, entry into premises, seizure of books and documents, witness requirements, and preservation of records.

Premium Payment and Risk Assumption Clarified

The draft rules also elaborate on circumstances under which insurers may assume risk before receiving premium payments. These include cases involving bank guarantees, advance deposits, government and semi-government entities, health insurance, aviation insurance, marine insurance, reinsurance, crop insurance schemes, and certain disaster-related policy renewals.

Public Consultation Open

The Ministry of Finance has invited objections and suggestions from stakeholders, insurers, intermediaries, and the public before finalizing the Insurance Rules, 2026. The draft is part of the government's broader effort to modernize India's insurance regulatory architecture and improve clarity, transparency, and operational efficiency across the sector.
