The Central Board of Direct Taxes (CBDT) has released the Search and Seizure Manual 2025, a comprehensive update to its earlier 2007 version, aimed at aligning investigation protocols with the era of digitization, data protection, and inter-agency intelligence sharing.

First introduced in 1985 and last revised nearly two decades ago, the manual serves as a guiding framework for officers engaged in search, seizure, and survey operations under the Income Tax Act. The 2025 edition integrates new laws, technologies, and enforcement practices to ensure evidence handling and investigations are efficient, lawful, and technologically robust.

Key Highlights of the Search and Seizure Manual 2025

Digital Evidence and Data Protection: The manual emphasizes the handling of digital evidence in accordance with the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023, and Bharatiya Sakshya Adhiniyam, 2023. Officers are instructed to maintain a strict chain of custody and use approved forensic experts for data retrieval and analysis.

Integration with National Data Networks: CBDT officers now have access to platforms like NATGRID, MCA's Corporate Data Management (CDM) Portal, and the Digital Intelligence Platform (DIP) of the Department of Telecommunications for gathering intelligence on suspected tax evasion, money laundering, and financial fraud.

Enhanced Inter-Agency Coordination: The manual formalizes coordination with agencies such as the CBI, RBI, SEBI, ED, FIU-IND, and CBIC through the Nodal Officer Mechanism and Regional Economic Intelligence Councils (REICs) for real-time exchange of information while maintaining data confidentiality.

Focus on Specialized Expertise: With the growing complexity of financial transactions, the manual mandates the use of registered valuers, digital forensic experts, and domain specialists to assist in searches involving bullion, jewellery, artwork, or encrypted digital assets.

Procedural Reforms and Digital Reporting: The manual makes the use of the Income Tax Business Application (ITBA) mandatory for filing Two-Hourly Reports, Preliminary Search Reports, and Appraisal Reports to ensure transparency, accuracy, and accountability.

Legal Updates and New Laws: Recent statutes such as the Prohibition of Benami Property Transactions Act, 1988 (PBPT Act) and the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015 (BMA) have been incorporated, broadening the scope of investigations.

Focus on Capacity Building and Feedback: CBDT Chairman Ravi Agrawal urged officers to treat the manual as a "living document" that evolves with changing economic realities and to provide continuous feedback for future updates.

The Search and Seizure Manual 2025 signifies a major shift toward data-driven, technology-enabled, and legally sound tax enforcement, reinforcing the government's commitment to transparency and fair investigation practices.
