HI

One of the Director has Two Din No. Then what should we do because he has filed DIN-3 with  one din no. in one company and with another in another compny. now if we process to delete his Din no. then shall we file din-3 again

the din which u take earliar and approved by mcs will be the din of the director. use that din insted of taken later.

First of all Sir, it cant be possible that a director has 2 dins. and if he has it is the voilation of the law. but as regard your problem, u just file the din 3 again with the original din which the director have which he took first.

Sir, If we again file DIn - 3 with MCA then there will be two directors of the same name registered in MCA. So what should be done to remove the name first uploaded with MCA using duplicate DIN and can the director surrender the duplicate DIN alloted to him.

Though it is violation of law to obtain 2 DIN for the same person, it is necessary to rectify the mistake.  It is always better to be late than never.  So far I have not encountered instances wherein the Directors have been penalised for obtaining 2 DIN.  However the solution to your problem could be like this.

Obtain the resignation of the director in the 2nd company and file form 32 for resignation.  Thereafter write a letter to the MCA Din Cell to get the 2nd DIN which was by mistake obtained revoked.  Please note that Form 32 for resignation has to be filed prior to the revocation of the 2nd DIN.  Once the 2nd DIN is revoked, appoint the person as director in the 2nd company by filing a fresh form 32 bearing the 1st DIN.  This will solve your problem.

 

Under section 266C obtaining two DINs is voilation of Law. 

 

Under section 266G if any director do so will be punishable with fine which may extend to Rs. 5,000/- and if such default is a continuing one wich a further fine which may extend to Rs. 5,000/- perday during which the default continues.

 

Thus, the director obtaining two DIN should immediately move forward, sue motto, to intimate the MCA DIN Processing Cell about the same.

Resign from the second company in which the second DIN was intimated and file form 32. Then get a fresh appointment with first DIN with all companies.

I think it is Rs 500 per day not 5000.

Please note that Form DIN-3 is required to be filed for appointment of any director, managing director, manager or secretary in the company; where the date of appointment is on or before 30th June’2007.

i had appliled for a din no recently and after making the payment and upload there was an error show in the system about some prescrutiny and the receipt was not generated so i tried to upload it again  and the second time it went through and i got the confirmation and the receipt of the transaction but later when i checked my mail there were 2 din no alloted to me so which one should i use and what should i do with the duplicate din no generated how do i cancel the din and i have already used the second din no generated, the with the receipt to submit the form1a for company name

you may raise ticket on mca website giving all the details and facts. there u request the mca officials to cancel other din.

one director has two din's out of one which is deactivated due to no submiting form DIR3 KYC, for another one which we try to file form DIR 3 KYC now - while click on prescrutiny button it is showing that PAN is already existed against another din( i.e which is deactivated as i said earlier) . Now what we have to do
