Tds on Rent - tenant deducted tds but didn't pay to Government.
The tenant has deducted tds from the rent but failed to pay to Government. Now Itax Dept claim the tax from the Landlord. Is there any defense available to Landlord

PLEASE FIND ATTACHED THE OFFICE MEMORANDUM ISSUED BY CBDT ON THE ISSUE OF NON DEPOSITION OF TDS BY DEDUCTORS. I AM SURE IT WILL SOLVE YOUR PROBLEM

As Mr.Sanjeev said, we can produce the CBDT memorandum, when departmental officers raise demand from deducted when the TDS deductor defaulted TDS payment to Government
