No, RCM is not applicable on receipt of Repair and maintenance services of factory machinery from Unregistered Person. The person will charge GST and you can claim the same as ITC.

The Person from whom Services for Repairs were taken is not registered. He won't be charging GST then whether Liability for RCM is borne by the Company or not.
