What is the penalty imposed if a Pvt. Ltd Co. fails to file annual return on time?

Dear Chetan,

As per Section 162 of the Companies Act, 1956, if a Company fails to comply with the provisions of Section 159, then the Company and every officers who is in default shall be punishable with fine which may extend to Rs. 500/- for every day for which default continues.

Further, offence under Section 159 of the Companies Act, 1956 is compoundale in nature.

u have to pay additional fees for delayed filing. u can calculate the amount of such additional fees from the "calculate fees" corner of mca portal..
