Hello. I want to confirm whether provision in any act applicable to India is subject to articles of indian constitution ?? I have this doubt when I have read appeal procedure in IDT & appellate directly approached in high court by writ petition... so want to confirm whether Indian constitution prevails over specific procedure prescribed under concerned act ??? Thanx for reading & replying.

The Constitution of India is supreme and any laws or Acts which violates the Provisions enshrined in the Constitution will be invalid. Thus any law, breaching the basic constitutional framework would be void and struck down.
