We have a company incorporated in 2006, where as no operations has been carried on Till date.But company has purchased few fixed assets. "NO annual returns have been filed till date". Company is in dormant status. Now the company mortagaged its property against a loan taken by some other entity..Banker wants to create a charge. we are unable to creat charge by filing FORM CHG-1 as company is in Dormant Status.
The form to change dormant status to active is MSC-4. Form MSC-4 is having a Mandatory Feild "Service request number (SRN) of Form No. MSC-1 filed form seeking status of dormant company" But we have never sought for dormant status it was assigned by MCA hence there is no such SRN available with us.
And there is another feild asking "Company remained in dormant status since" here also we dont know the date. Please show me a way out to create Charge against comapny's property.
ANNUAL RETURNS ARE NOT YET PREPARED.Is it mandatory to file annual returns or can we take 21 days time to file all annual returns after it is converted into ACTIVE. Thanks in advance
