Does disputed will attract capital gain

One Mr RK inherited a property via an unregistered will duly witnessed .Mr RK sisters claimed their shares in the above property and gave some sort of notice. Mr Rk then made a declaration of the will in the court .The dispute was resolved and the sisters gave their share to mr RK after compromise.  "Question is      If Mr Rk sells the above property now what will be the holding time of the property in respect of capital gain calculation.  1. From the date of will till Date or 2.From the date of the judgement of the court in favour of Mr RK."

it will be the time the property was purchased by the deceased from whom property got inherited
