I want to change the place of business of my client to a new rented premises. 

 

Could you please guide me on:The exact list of documents required for updating the address in GST .

 

Whether a rent agreement of at least 11 months and a landlord NOC are mandatory, and what key clauses they should contain.

 

Also Share a Word‑ready format for the rental agreement and landlord NOC suitable for a proprietorship firm in Maharashtra.

Exact Documents Required (Rented Premises – Maharashtra)

For GST amendment (change of address), upload:

1️ Proof of Address (Any One)

  • Registered Rent Agreement
  • Lease Deed
  • Consent Letter + Ownership Proof
  • Electricity Bill (latest 2 months)

2️ Rent Agreement (if rented)

Preferably:

  • Registered (in Maharashtra registration is advisable)
  • 11 months is common practice (not compulsory under GST law but practically accepted)

3️ Landlord NOC (if not clearly mentioned in agreement)

Required if:

  • Agreement does not clearly permit commercial use
  • Agreement is not registered

4️ Ownership Proof of Landlord

  • Property Tax Receipt OR
  • Latest Electricity Bill OR
  • Sale Deed copy

Is Landlord NOC Mandatory?

Not mandatory if:

Registered rent agreement clearly mentions:

Commercial use

Permission to use for GST registration

 

Mandatory if:

Agreement is not registered

Agreement silent on commercial activity

 

Is 11-Month Rent Agreement Mandatory?

 GST law does NOT prescribe 11 months.

 But practically, officers expect minimum 11 months for stability.
 Even 3 or 6 months is legally valid, but may invite query.

 Professional advice:
Use 11-month registered agreement.

Key Clauses Required in Rent Agreement

Make sure following clauses exist:

1️ Full address of premises
2️ Commercial usage permission
3️ Permission to use address for GST registration
4️ Rent amount + security deposit
5️ Duration (start & end date)
6️ Signature of both parties
7️ Witness signatures
8️ Stamp duty as per Maharashtra Stamp Act

 

RENT AGREEMENT

This Rent Agreement is made on this ___ day of ______ 2026 at Maharashtra.

BETWEEN

Mr./Ms. ____________, residing at ____________, hereinafter referred to as the “Lessor”,

AND

Mr./Ms. ____________, Proprietor of M/s ____________, having PAN ____________, hereinafter referred to as the “Lessee”.

2.     The premises shall be used for commercial purposes, including conducting garments business and obtaining GST registration.

6.     The Lessee is permitted to use the premises address for GST registration and other statutory registrations.
