Whether Cenvat Credit can be claimed of Excise duty paid on Steel & Cement ( Input) for paying Service Tax Liability?

Dear Mr.Sagar.

Please ellobarate your querry properly.CENVAT Credit to be availed and not to be claimed. Towards which Catagory of Service, you wish to utilse CENVAT Credit of Central Excise Duty. Your registration with Service Tax Authority is under which Catagory of Service?

1) My Registration under Service Tax is Under Category " Construction of a new residential complex or a part thereof" .

2) Company is providing service of construction werein it provides material & service of contruction. For the materials purchased excise is paid by us while purchases.

3) Can we avail Excise duty paid on purchase of materials for payment of Service Tax Liability.

Dear Mr. Sagar,

If you are not claiming abatement of 67% under notificatin 1/2006 dated 01.03.06, you can avail CENVAT Credit on all inputs which are used in relation to construction of residential complex. And the same can be used for setting off the service tax liability on your output service.

 dear sir / madam

                                   we are a ssi unit registered with service tax and excise department. 

we are doing job work for companies like INDIAN OIL and Hindustan Petroleum. We fabricate storage tanks for these companies using the steel plates supplied by them. the steel plates supplied by them are on excise challan ( Cenvat challan ). 

in this case what is our liability of service tax and excise.

The payments made to us by these companies are subjected to a deduction of 4 % WCT on the entire amount paid to us.
