Cost and Works Accountants Bill should be dropped: BJP

 

New Delhi, Dec 19 (PTI) BJP today unofficially conveyed to the government that certain terms used in Cost and Works Accountants (Amendment) Bill, 2011 - which was passed amid the din in Lok Sabha - were in violation of the agreed norms and should be dropped.

Corporate Affairs Minister M Veerappa Moily moved the Bill to amend Cost and Works Accountants Act, 1959 for consideration and passage. It was passed in the din in Lok Sabha along with three other Bills, denying the members an opportunity to debate the details of the legislation.

Later, some BJP members from the Lower House met Moily and pointed out that the Bill used the term "management" in a few clauses, which was not acceptable.

"In Clause 4, section 5 of the Bill, in place of AICA (Association of Institute of Cost Accountants), the Bill says ACMA (Association of Cost and Management Accountants).
Similarly, instead of FICA (Fellow of Institute of Cost Accountants) the Bill says FCMA (Fellow of Cost and Management Accountants)," a BJP MP said.

Except for Bangladesh and Singapore, no other country uses the term "management" as part of nomenclature for Cost and Work Accountants, chartered accountants, et al.

Clause 8 of the Bill states "Institute of Cost Accountants of India" as both the amended and the original terms. The Bill was aimed at removing Works from the original Bill which said, "Institute of Cost and Works Accountants of India".

Sources said the government is likely to take the plea in Parliament that these were "drafting errors" and shall be corrected. They said the government officials also maintained that the term management was being used as it was a request from the professionals concerned.

Opposition can press for fresh passage of the Bill with the necessary changes, they said.

The Rajya Sabha has already passed the Bill with these anomalies.

Regarding CMA name I want to share Technical opinion that once the bill cleared from RS & LS . it can’nt be changed without assent of parliament saying that it was typographical error . bill can change only after fresh approval for RS &LS.
One of BJP MP try to protects against the CWA bill but unable to succeed bec’se one on Samajwadi party member pulled his leg & BJP MP was very angry. Now CA institute will demand refund of money from BJP MLA.
CA institute members are also opposing same designation of CA for both the institute . CA ins. Developing CA Name since last 60 years & ICWA can’t take the name from CA inst.
Govt. also want that name should ICMA from institute of cost accountants of India & no one can make govt. fool. All big positions in govt. held by Lawyers. & govt. can do that they want directly or indirectly.
After approval from President it will convert to CMA act & member can use ACMA & FCMA

Discussion on CA Meerut Group on New Name of ICWAI

Dear Members,

Shri Partha Ray has written effectively on this issue.
Both Institutes are governed by an Act of parliament.
ICAI should have protected its abbreviation through
copyright in India.
ICAI stands for Institute of Chartered Accountants
of Ireland also.
Now only Supreme Court can save ICAI
having established in 1949 and
the present amendment/permission to
call cost accountants as CA should
be struck down.
Otherwise should we file a PIL???

Why should the Cost Institute not be named The Institute of Cost & Management Accountants of India ? If this mischief is not corrected at once, I am sure the CMAs will outnumber us very soon and call themselves CAs (Cost Accountants).
In fact, they have been active earlier to merge the 2 Institutes with our ICAI so that their members can elevate themselves and proclaim themselves at par with Chartered Accountants.

I appeal to our Central Council members to raise this issue at the right forum and put this confusion to rest. In case some Cost Accountants now starts writing their Membership Number as ICAI Membership No. 00000 (as that will not be illegal) the outside world will not be able to differentiate between a CA and a CMA.

This is shame on CA and CWA both.
Members of ICWA is not enough competent to recognise their name and profession, That's why they want to use the name of CA name, dignity, reputation and honour. A donkey remain donkey never can be upper.
No office bearer of the central committee of the ICAI raise their voice for such conspiracy. They may have sold their honesty, self respect and dignity. The CA logo is only for the CA member, only CA can write word CA before their name. If they can not the save the name CA, how they can be expected to save the interest of profession..

Dear Sir,

I personally feel its much ado about nothing. The general public know only CA, most of them don't even know what the ICAI is. In fact, they gape in surprise when they hear that a professional is regulated by an 'Institute'! Some have asked me why does an Institute have power over a working person? Shouldn't it be an Association like ASSOCHAM of FICCI?
Common initials should not matter. There is the Institute of Computer Accountants of India, which uses the initials in a very useful manner (though the logo and letters are different).
CA's in jobs don't suffer from any confusion, as their CV's are screened only at the time of interview, and after that, it is performance. Practising CA's in any case are mandated to use the full words 'Chartered Accountant' against their name.
Let our work define us, and not just some initials. Let people know a CA as someone who is a Chartered Accountant, and not vice versa.

Icwa are much more competent and capable And recognised in india and abroad enough than ca.Name change is vital.
