Policy Circular No. 2 (RE-06)/2004-2009          April 10, 2006

To
         All Commissioners of Customs;

Subject:- Import of Compressors without ODS and without refrigerant gas.

1. A number of representations have been received from various quarters seeking clarification regarding importability of Compressors filled with non-Ozone Depleting Substances.

2. The matter has been examined by the Ministry of Environment & Forests who have clarified that “as per rule 12 of the Ozone Depleting Substances (Regulation and Control) Rules, 2000, importers of Compressors have to be registered with the competent authority for import of Compressors using Ozone Depleting Substances. Registration requirement will not be applicable for importing Compressors using non-Ozone Depleting Substances, or Compressors which do not contain any refrigerant gas”. Based on this clarification, Customs may allow import of Compressors filled with non-ODS substances.

3. This issues with the approval of DGFT.
