Gujarat HC Demands Accountability from GST Officials for Cryptic Notices

The Gujarat High Court has taken a stern stance on the cryptic nature of notices surrounding the cancellation and suspension of GST registrations, demanding the presence of three senior officials from both the state and central GST departments. The move comes in response to a Bhavnagar-based firm's challenge against the Central GST department's Bhavnagar unit, which swiftly cancelled their GST registration without allowing adequate time for a response.

The Bhavnagar firm found itself in the crosshairs of the Central GST department, as it was expected to submit a response to the cancellation notice on the very day it was received. Faced with this abrupt action, the company sought legal recourse and approached the Gujarat High Court for relief.

During the hearing, Sukhjit Kumar, the Commissioner of the Bhavnagar CGST unit, appeared before Justice Bhargav Karia and Justice Niral Mehta on Thursday. The court expressed its frustration with the department's failure to adhere to guidelines regarding the proposed cancellation of registrations. The court emphasized the need for a fair and transparent process, questioning the haste in canceling registrations without allowing affected parties sufficient time to respond.

The senior officials from the state and central GST departments assured the High Court that they would comply with its orders to address the issue at hand. Subsequently, the court disposed of the matter, highlighting the significance of procedural fairness and adherence to established guidelines in matters related to GST registrations.

However, the court's dissatisfaction with the department's conduct was palpable, and it warned that contempt notices could be issued if guidelines continued to be flouted. This development raises questions about the accountability and transparency of the GST cancellation process, emphasizing the need for a balanced approach that considers the interests of businesses and ensures due process. The outcome of this case may have far-reaching implications for how GST registrations are handled in the future, urging authorities to revisit and refine their procedures to avoid similar legal challenges.
