GST on Apartment Maintenance: No Burden on Residents, Clarifies FM Sitharaman

Finance Minister Nirmala Sitharaman has clarified in Parliament that individual residents living in apartments are not liable to comply with Goods and Services Tax (GST) regulations, even if they pay monthly maintenance fees above Rs 7,500. The compliance responsibility rests solely with the apartment associations, not the residents.

In a written reply to the Lok Sabha on Monday, the Finance Minister explained that apartment associations must register under GST if their aggregate turnover exceeds Rs 20 lakh (Rs 10 lakh in special category states) in a financial year. They are liable to pay GST only when the monthly maintenance per member crosses Rs 7,500.

"No GST compliance requirements have been placed upon the residents of apartments, irrespective of the monthly maintenance amount paid," Sitharaman emphasized.

Additionally, outreach initiatives such as Taxpayer Samvad, workshops, and awareness programs are conducted regularly to improve compliance and awareness.

This clarification aims to ease confusion among apartment residents and housing societies regarding tax obligations and ensure smooth GST compliance by relevant associations.
