Without deduction of TDS

One of our clients paid for consultancy fees without deducting TDS. After that the company paid out of thier own money and that amount not received from the deductee. Bill Amount is Rs.1,00,000, TDS Paid Rs.10300. whether the company can clime 1,10,300 as expenditure. please send the answer.

Only Exp amount Rs. 1,00,000  is allowed ... TDS is not allowed ..

even the company paid the dts out of own money its obligation of the company to deduct tds and remit the same to the govt.hence Rs.1,00,000 only claim as exp.
