I want to know if an assesse had not provided his pan to the deductor than at what rate tds should be deducted
whether higher of rate applicable Or 20%
Or someother rate for AY 2010-11

hello
if assessee has not provide his pan no. to deductor then normal rates shall applied for a/y 2010-11.
bt from a/y 2011-12 rate will be 20% in the same case.

The applicable rate will be the higher of the rate as stated by the law under the respective section or 20 % flat rate.

Dear Sonia
With effect from 01.04.2010, if details of PAN No. is not being furnished to the deductor than deductor should deduct tax at normal rate or 20% whichever is higher
