Tds on expenses before receiving tan

Tax queries 726 views 3 replies

Hi All

I have a query pertaining to TDS deduction. Company incurred some pre-incorporation expenses lik professional fees, etc., in say February; however, TAN was allotted to the company only in March.

Whether TDS needs to be done? If yes, when should the same be remitted to the department?

Thanks in Advance

As these are pre-incorporation expenses, these must have been incurred by Promoter. Therefore, it needs to be reimbursed to promoters and no TDS need to be deducted on this.

Thank you. How about expenses incurred post-incorporation but before receiving TAN??

Then, you are required to deduct TDS if you are not paying it through reimbursement.
