We are providing the P G to our company New Employees for one month, they charging rent on daily basis per employee. Rent amount reaching more than Rs.1,00,000/- per year. I want to know whether TDS applicable or not for the PG rent????

Just i want to know whether TDS applicalbe or not.......... because few people told me that TDS not applicable for PG rent and its like hotels room rent. We have not made any agreement or contract between company and P G.
Lets clarify briefly.......
TDS is applicable @ 10% if rent amount exceeds Rs. 180,000/-
Service tax shall not considerd while calculating tds.
agree with above tds is not applicable since it is not exceed rs 180000
before going to TDS, make it clear that bills raising on individual employee names or company, if it is on individual name, tds is not applicable, if it is on company name TDS is to be deducted, when Exceeds 180000 Per anum.

according to facts as stated by yourself there is no TDS applicabilit even if billing by landlord/possessor is done in the name of company as annual rent is less than Rs. 180000/-
It does not make any difference that wheter company entered into aggreement or not, for the purpose of TDS compliances.

Yes, TDS not applicable if it does not exceed Rs.180.000/- p.a w.e.f 1/7/2010.
