Dear Caclub member,

Our building is going under reconstruction and we are going to get 20,000 pm as rent for shifting until the new building is ready. My queries are

1 Whether the amount received by us will be taxable???

2 If not taxable in my grand fathers hand since the flat is on my grand father name. One of his grand son ie my cousin brother has two flats an if we shift in my cousin's flat and pay him rent than he will be taxed for the rent received. Can the amout of rent money be given by my grand father as gift to my cousin to avoid tax??? how much money can be given as gift without being taxable .....

 

I am registered for CPT hence not aware of Income tax properly.

 

Please help and thanks in advance.

Hi Sapna,

 

Yes, the amount recd by you will be taxable as income from other sources, but, if the rent is actually paid to someone, including your relative, you will get a deduction under section 80GG of the Income Tax Act, 1961 of maximum Rs. 24000 per annum (2000p.m)

The tax will be in your grandfather’s hands, and has got nothing to do with the fact that after its receipt, he transfers the money to your brother.

madam, the giving of rent in the form of gift is not tax avoidance but tax evasion. So decide judiciously. Also, there is the issue of notional rent in the case of your cousin, since he is owning two flats.

But the rent we are getting is a compansation and not income??? what if the builder would have given us accomodation till the new building is completed

the question of taxation arises simply because you are gettin gmoney..

 

if he were to provide the accomodation, the question of he paying you wouldnt come and thus taxz would not come....

But rent is not our income since the area where will live we need to pay extra to find accommodation and even pay tax for not earning anything. It is like reimbursement of rent paid.
