Tax exemption on gratuity

Dear Sir,

              Our University (Lala Laj Rai University of veterinary & Animal Sciences, Hisar) was established by state legislation act and is a state university. Hundred per cent funding is by state government for salaries and the allowances. Haryana government is the appropriate government for the university. Earlier, the retirees used to get full tax exemption on Rs. 3,50,000/- gratuity. The gratuity limit has been increased from Rs. 3.5 lac to Rs. ten lac, however, the income tax department is allowing tax exemption for Rs. 3,50,000/- only. My query is whether our employees are ellegible for full tax exemption of ten lac gratuity?

In case of a Government employee, Gratutity received at the time of Death or retirement is wholly exempt from tax under sec- 10(10)(i)....

Therefore, in my view full exemption of Rs 10 lacs should be allowed...

 

Yes, Your employees are eligible for full tax exemption of 10 lakhs. After the amendment of gratuity limit as per POGA act. The gratuity limit was changed even in income tax act from 3.5 lakhs to 10 lakhs. (Refer Notification No 43 dated 11.06.2010)
