Dear Sir/Madam, Order passed by commissioner of Service Tax includes the amount of Service Tax to be payable and penalty u/s 77 & 78.
My query is that if i want to file appeal against the order of commissioner, will it be required to file 3 separate Appeals?
1. Against the liability of Service Tax
2. Against Penalty u/s 77
3. Penalty u/s 78
will the amount of fees deposited be separately in each different cases???
on the basis of total value of demand, the juridication of appeal get fixed,
bettter to get in touch with a lawyer of indirect taxes, and get consultation, it may vary from additional commissioner to joint commissioner or CEGAT,
with the help of a good consultant in hand, most of assesees get relief
you are required to file only one appeal as per format given in ST-4 or ST-5(as per your case). Appeal filing fee will be given only for one Appeal.
