Hi all

 

A company has entered into rent agreements for its retail offices in various parts of the city. In case of few premises, rents are in excess of service tax SSI exemption limit. However, the landlord is not charging any service tax.

 

Is there any risk to the company in such a scenario?

Since, Section 68 of FA,94 provides that the Service Tax is payable by Service provider. Hence, there is no risk to such a Company.
