Yes .. you can get SAD refund .. For that you should get all the bill of entries audited by a Chartered Accountant and with his sign in the prescribed form (different for different States) you should submit it to the authorities

It doesn't matter Importer hold VAT or not right!!!

The importer don't need to specify or mentioned anything while raise/sell to VAT/CST trader, right!!!

yes.. Trader cannot get... But here the case is about importer and he can get if he certifies it in annexure III with a Chartered Accountant

You should get the expert advice from a CA coz the procedure involves an audit and finalising . This is not childs play
