Quick Summary
This discussion addresses the eligibility for GST refunds for the financial year 2017-18, specifically concerning the two-year time limit for claims. While generally refunds must be claimed within two years from the relevant date, there are potential exceptions, particularly for excess taxes paid where liability didn't arise, such as on export transactions. However, pursuing these exceptions might involve litigation.

As per the provisions of gst act refund cannot be claimed after 2 yra

If the refund is on account of excess taxes paid (incorrectly) where liability did not arise in the first place - 2 year time limit could be disputed and refund should be eligible. (Ex: Tax paid on export transactions - refund should be eligible irrespective of time limit) - but this can be litigated.

Under GST, the applicant should file GST refund claims within 2 years from the relevant date. If the claim is vaild, the refund will be sanctioned within the period of 60 days from the date of receipt of the application.
