Query regarding - Re-export of imported goods (Drawback of Customs duties) Rules, 1995 read with under section 74 of Customs Act

we have been advised by our CHA to submit the below mentioned documents with Customs (as the Customs insist upon the same)

List of documents required for filling paper U/S 74 Re-Export shipment
1. Original Re-Export Invoice & Packing List (Duly Signed & Stamped)
2. Original GRW Certificate
3. Import Invoice & Packing List
4. Original Bill of Entry (Duplicate Copy)
5. Original Bill of Entry (Triplicate Copy)

6. Original TR6 Challan
7. Excise Certificate regarding non-availment of MODVAT
8. Copy of correspondence with the supplier of the imported goods Regarding reasons for re-export of the said goods

 

Kindly advise, do we require to submit the Original Bill of entry (Triplicate – which Is meant for Exchange control) ?

As the Triplicate copy of  BoE is retained by the Bankers at the time of issuance of G R Waiver, hence it cannot be submitted to customs,
