We are a hotel and primarily registered under Mandapkeeper services. However we have also provided space on terrace to Mobile vendors. We sincerly feel that these services do not fall under the category of Renting of immovable property.
Further according to us it shall also not fall under the category of sale of space as it does not pertain to display or advertisnment.
Request experts to let us know in which chargeable category to include the following services.

THE CASE IS PENDING WITH SUPREME COURT AS MANY HAIGH COURTS GAVE A VERDICT THAT RENTING OF IMMOVABLE PROPERTY DOES NOT FALL UNDER PREVIEW OF SERVICE, SO SERVICE TAX CAN NOT BE IMPLEMENTED
PLEASE WAIT SOME DAYS OR GET A CONCENT LETTER FROM MOBILE VENDOR IN WRITING THAT IF THE GOVT WINS THE CASE AND IMPLEMENT THE SERVICE TAX THEN YOUR TENANT WILL PAY ALL THE SERVICE TAXES DUE IN HIS NAME
