Penalty of Rs 50 or 20

i have to file gst 3b return
for last few monthes. i have itc unclaimed on those months. if i claim the ITC of the month in its respective month does it attract penalty of Rs 50 per day or 20. I don't haves sales for those months.. please help me out

Late fees is being calculated automatically. It will be better for you to file returns correctly.

Late Fees Structure U/s 47 of the CGST Act 2017 for late filing in FORM GSTR-3B :

1). For Tax Liability Return = Rs. 50 per day ( Rs. 25 under CGST Act + Rs. 25 under SGST Act ).

2). For Nil Return = Rs. 20 per day ( Rs. 10 under CGST Act + Rs. 10 under SGST Act ).

However note that the late fees is auto calculated by the system itself. You are not required to calculate it separately and disclose it in your GSTR-3B. It fill be prefilled by the GSTN System.
