Misuse of pan by ex-employer

you need to file income tax return for claiming this refund of TDS if your taxable is with in limit

you need to submit to your employer the investment particulars for them to assess under salary taxation part

please see as on date your AS 26 whether this credit is available and in that case there cannot be any worry for misuse of PAN etc i suppose

please investigate further
