We are doing a Maharashtra state govt project in joint venture with one of the civil contractor. Civil contractor is the lead partner and all the payments by govt department are released in his name. This joint venture was required by the govt department as he was not having experience and was not qualifying. Our joint venture agreement is in the recond of givt department in the project file. It was his proproitory firm.
In the middle of the project execution the civil contrcator expired. Now the situation is very cheotic at his family end. His brother, wife and son have jumped in the fight for the money.
Meantime the work at site is at standstill. I am also supposed to get some payment from him after completion of the job. Our terms as per agreement are back to back.
My question is can we approch govt department to ask for direct payment to us as a joint venture partner ? what is the procedure.
