i want to know the due date of filling income tax return for the f.y 2010-11 a.y 2011-12 of a private limited company

Dear Kavitha,

Due date for filing Income Tax Return for A.Y.2011-12 are as follows.

Differene Assesses Due Dates

1. Where the assessee is a company September 30

2. Where the assessee is any person other than

company

1 .In case where the accounts of the assessee

are required to audited under any law September 30

2. Where the assessee is a working partner in a firm

whose accounts are required to audited under

any law. September 30

3. In any other case July 31

I think Returns for AY 2010-11 is also pending. So as early as you file tthe return, you will save something in terms of Interest.

Can any one tell me what is the due date of return filing of partners in case of partnership firm?

What is the meaning of working partner under this clause?

Is it make any difference when partners are sleeping partners in there due dates?

Moin Sir, u have specify that "if there Where the assessee is a working partner in a firm whose accounts are required to audited under any law." Here please clear me that u have used sentence that "Accounts to be Audited" is of Firm or for Partner?

Dear Amitkumar,

Please have look at the following example.

XYZ & Co. is a partnership firm in which there are three namely X,Y,& Z. X & Y are working partners who take part in day to day activities of the firm whereas Z is a sleepng partner of the firm as per the partnership deed . Now the Gross turnover of XYZ & Co. for the P.Y.2011-12 is Rs. 100 lacs.Thus XYZ & Co. is liable to get its acount audited u/s. 44AB.Thus Due date for filing the return of Income u/s.139(1) is September 30,2012.

Now as per statute, Since X & Y are working partners of the firm, the due date of filing the return of Income for them too is 30th September,2012 u/s.139(1) whereas since Z is sleeping partner the due date for him would be July 31,2012.
