Income tax on foreign company salary

Hi All,

My brother is working for a Malaysian company but in India.

Means..salary comes to India but his company is not registered in India hence there is no TDS/Form 16 etc.

How can he file tax?

What is the slab?

His EPF amount is being deducted at source.

After deducting pf if his annual salary exceeds Rs 2lakhs he has to file Income tax return and pay taxes even no TDS is made. The slab is up to Rs.2 lakhs Nil tax, 2 to 5 lakhs 10%, 5 to 10 lakhs 20% and above 10 lakhs 30%.  Return can be filed on line through E filing web site of IT Dept.

Income will surely be taxable in INDIA. Does the company deducts tax in Malaysia through form W2. In case yes, your income is covered under double taxation avoidance agreement with Malaysia. Relief need to be computed and Form ITR 2 need to be filed.

There is no deductions for him in Malaysia via any form.

Now since the company is not registered in India(No TAN) how he can file online in India as online form asks all details of employer.

I believe you can not put any name in the employer field & put any amount as income as it will be verified by the IT dept.

He wants to file the tax so please help.

 

 

No problem in giving employer name and income amount. If only TDS is made it will be verified.
