Dear Experts,

My brother is working in Infosys and went to united states in the midle of Nov'13 on company work , His family staying in India , He is unable to submit the rent receipts in time. so they have not considered

and deducted IT and sent the Form16 accordingly.

Kindly advise how to proceed

Thats fine. You can claim your HRA deduction in ITR

no problem. he can claim hra while filing his itr and get refund of excess tds deducted.

In such casees, from which particular we get deduction in ITR 1 (java utility) as they dont provide space for deduction U/s 10

@ mamta... hra should be reduced directly from taxable salary as per your form 16 and then the reduced salary will be mentioned in itr.

Here do I need to send supported documents like rent receipts to IT department? Please guide me as I am first time filling e return.

Reduced salary after deduction will not match as per form 16. In such case can IT department create an issue?

no.. no issue on such case.. you will just have to prove that you claimed hra. you need to keep those rent receipts for that purpose upto completion of assessment of your income.
