Taxation for sale and purchase of REIT shares

Dear Sirs,

Kindly advise me on taxation on sale and purchase of REIT shares and which ITR form to be selected for this purpose. Does it fall under business income . Thanks

Quick Summary
REIT unit transactions are generally taxed as capital gains-15% STCG and 10% LTCG above 1 lakh. ITR-2 is used for investors; ITR-3 applies if treated as business income based on trading activity.

Sale of REIT units is normally taxed as Capital Gains:

  • 15% for short term

  • 10% above ₹1 lakh for long term

Use ITR-2 unless you are actively trading, in which case use ITR-3.

It does not automatically fall under business income unless trading pattern indicates so.
