A private company got EPF registration mandatorily as required during incorporation in 2022. The
company stopped its operation since last 2 yrs due to loss, all employees left and go for strike off now. It never had more than 20 employees while active and no EPF return was filed. I have mentioned the summary as shown after
establishment search in EPF portal.
Validity Status (As per Online Coverage)
Establishment Status: CODE NO ALLOTTED WAS AFTER ONLINE REGISTRATION STARTED.
Registration Status on ECR Portal: PERMANENT LOGIN CREATED BY OWNER ON ECR PORTAL
Establishment Status (As per EPFO Master)
Working status: Live establishment
Coverage Section: 0000001(4)
Actionable Status: ACTIONABLE ESTABLISHMENT
Date of Coverage: 2022
Establishment Details (As per Form 5A submitted Online by the Employer)
Section Applicable: VOLUNTARY COVERAGE
After login to EPF portal following information is displayed.
NOTE: My company has obtained EPFO Registration number at the time of its incorporation though the employment
strength has not reached the threshold limit of 20 for applicability of the EPF & MP Act 1952. I understand that my
company has to start compliance under the Act once the employment strength reaches 20. I also understand that in
case my company does not start the compliance even after reaching the threshold limit of employment EPFO may take
appropriate action under the Act on receipt of any complaint or information from members or any third party.
After that there is option to choose act applies to my establishment: 1) EPF act applies to my establishment 2) voluntary
coverage application as act doesn't apply.
These are some queries that I have in this regard.
1) How to surrender EPF registration in this case?
2) Should the company select "voluntary coverage application as act doesn't apply" after login and then proceed to
surrender EPF registration in its website? Is it wise to select above option when there are no employees and company going for strike off??
Looking forward to your reply. Thank you.
