The concern that government supply leads to "double taxation" is a common misunderstanding of how the Goods and Services Tax (GST) credit mechanism operates. Under the GST framework, there is no double taxation if the system is followed correctly.

Here is an explanation of why this happens and how the system works to prevent it:

1. The Input Tax Credit (ITC) Mechanism

The core principle of GST is that it is a tax on value addition. You do not pay tax on the full value of the goods at every stage; rather, you only pay tax on the value you add.

  • Purchases: When you buy raw materials or services to fulfill a government contract, you pay GST to your suppliers. This amount is recorded as your Input Tax Credit (ITC).

  • Sales/Supply: When you supply the finished goods or services to the government, you charge GST on the total invoice value.

  • The Set-off: When you file your returns, you are allowed to subtract the GST you already paid (the ITC) from the GST you collected from the government. You only pay the "net" difference (the tax on your value addition) to the government.

2. Addressing the "Double Tax" Perception

The feeling of paying "twice" often arises from two specific scenarios:

  • Cash Flow Issues: When you pay GST on your inputs, your cash is tied up until you can claim and utilize that credit. Additionally, if the government deducts TDS (Tax Deducted at Source) at the time of payment, it can feel like a further reduction in liquidity. Note that TDS is not a final tax; it is credited to your electronic cash ledger and can be used to pay your future tax liabilities.

  • Classification Disputes: Sometimes, disputes arise over whether a transaction is "Intra-state" (CGST + SGST) or "Inter-state" (IGST). If a business pays the wrong type of tax (e.g., pays IGST when the government demands CGST+SGST), they may be asked to pay again. In such cases, the law provides for a refund of the incorrectly paid tax, but the process can be cumbersome.

3. Key Takeaways for Suppliers

  • ITC is your friend: Always ensure your suppliers are registered and are filing their returns correctly. If they do not upload the invoices, you cannot claim the ITC, which would effectively lead to a higher cost (cascading effect).

  • TDS is an Advance: The TDS deducted by government departments is not an additional tax burden; it is an advance payment made on your behalf. Ensure that the government department has filed their TDS returns so that the amount reflects in your GSTR-2A/2B or electronic cash ledger.

  • Refunds: If you have paid tax twice due to a technical error (e.g., wrong classification of supply), the law permits you to apply for a refund of the tax paid incorrectly.

Summary: There is no double taxation in the GST system. You are meant to claim Input Tax Credit (ITC) on the taxes paid on your purchases to offset the tax liability on your sales. Any tax deducted by the government as TDS is credited to your account for future use. If you feel you are paying twice, it is likely due to a failure to claim ITC, incorrect tax classification, or issues with invoice reporting.
