GST impact on maintainance charge on flats

Can builders levy maintainance charge @ 18% to flat owners of unregistered housing society who are paying less than rupees 5000/- pm as maintainance charge.

Yes, builder is registered dealer and giving service of maintanance. (the exemption limit is for housing societies, but not for others)

But GST rules says the charges are applicable for those who are paying above Rs. 5000/- pm and having a corporal fund of twenty lakhs in respect of registered society
