Gratuity payment

My Colleague  was working in an Company for 9 years and six months( joined Company  on March 1st 2003 ).She has  resigned her job last year( 2012) on 30 th Sept'12.

Her Company is saying that she is eligible for Grauity only for 9 years and not for 9 years,six months.

Request you to please let  me know whether she is eligible for gratuity for 9 years or for 9 years six months, or is it payable for 10 Years(rounded off)

if she has worked for more than six months then she will be getting 10 yrs gratuity, else only 9 months gratutiy.

 

There is no provisions for 9.5 months as such in law.

She has completed 9 years six months  exactly.Is she eligible for grauity for 9 years, 6 months or for 10 years ( rounded off )

since its exact 9 yrs & 6 months then only 9 years gratuity is paid & not 10 yrs.If its in excess of six months then only its rounded up (applicable for employees covered under gratuity act)
