Gratuity act-applicability

Gratuity Act states that Employee as per Sec2(e) does not include "any such person who holds a post under the Centarl Government or a State Government"

 

My father is a Central govt. employee & he is entitled to gratuity,on the other hand  my sister is  a State govt employee but she is not entitled to gratuity.

 

My query is,when Gratuity Act doesnt apply to any central and state govt employees,why my father is entitled to it?& if he is ,why not my sister?

Simply said it is not apply on specified institutions because that institution is giving same type of other benefits by whatever name called.

and Appropriate Government shall exempt any institution because of more benefits given by their T&C of that organisation as compare to Gratuity Act..

Generally a gratuity act to provides a Process for the payment of gratuity to employees engaged in factories, mines, oilfields, plantations, ports, railway companies, shops or other establishments & for matters connected therewith or incidental. Any government organization given more benefits by their T&C under gratuity act.
