FORM 16 DOES NOT SHOW HRA EXEMPTION CLAIMED

Hello,

My organization allows me HRA.

However, I could not submit the receipts on time and as such it doesn't show in my Form 16.

I have already left the organization and when i am trying to reach the payroll, they are not co-operating and said they cant revise form 16.

What do i do now. ?

If this is not allowed i'll be facing a significant loss.

How do I claim the entire HRA allowance I am entitled for?

kindly explain the problem to the management why u were not able to produce the receipts . if they dont change they i think u cant claim because ur employer has to agree and should issue a revised form 16. The main criteria for HRA exemption is that u should produce the receipts to ur employer only then he wil believe that u r residing at a house in a particular city. I think ur employer should give u revised Form 16.

Your employer is correct-

during the begining of FY employer will be asking for investment declaration.At that time you can claim the full benifits u r entitled to an individual under the IT Act. On the basis of yr declaration employer will be calculating yr tax liability  for the entire FY and deduct the tax on a prorata basis.

By the end of FEB u have to submit proof for yr declaration,failing which the emp will recalculate yr tax liability and the balance amount of tax deductible according to the revised calculation will be deducted from yr FEB & March salary.

No employer will compromise on this as this will lead to audit abjection as default under sec 192B.

Now the remedy available to you is accept the Form 16 and file return and cliam refund.

I agree with above members

but u can do one thing. In this you have to take little risk. During filling of Return no need to deposit Form 16 with ITR so u claim HRA also. If in any case Assessing Officer demand for your form 16 (very less chance for demanding it) then u can explain your problem also or then pay tax thats it.  one other thing if your refund is here then dont do it.

I think ur case is that of claiming refund on account of house rent.  Although ur employer has not given ur the relief on one pre-text or the other, U need not worry.

Fill up the ITR claiming the house rent benefit.  compute ur reduced tax liability.  Show in the relevant column about the excess TDS and calculate ur refund. 

My further advice to u is that in case the payment of rent has been made by way of cheque, then pls annex a sheet mentioning the cheque details as well the details of the house owner also.  This will show that ur case is genuine.  In case the payment has been made by way of cash, then also need not worry.  Just annex copies (attested) of the rent receipts.

 

I left my previous job, 2 months back and i did not claim HRA & medical bills. The form 16 which i reccived from my previous employer contains HRA & medical claim as taxable income & has deducted tax accordingly.

Now how can i claim HRa & medical claim for tax exemption.
