Filling ITR 1 with 194j ?

Hi CA Club,

 

I'm a pvt sector IT employee and I've a monthly salary, TDS and Form16. I take private training sessions in the weekend through vendors and have got a income of around 2L for this financial year (2013-14), also with TDS and form 16.

 

My Form 26AS (TRACES) shows only TDS deducted from my employer under 192 section and vendors (for training) under 194J section. No other TDS...

 

I also have a Home loan and the house is on let out mode. I'm planning to clam the complete interest benefits from this home loan.

 

My question is which ITR form should I use for filling my return and what are the sections in the form should I use to declare all of the above income, Please suggest ?

You can file ITR-1 mentioning the income from vendors training under "other sources" and claim TDS. If you have exempt income over 5000/- than file ITR-2.

Sorry I can't understand the meaning of "If you have exempt income over 5000/-". FYI, total income after TDS from other sources is 1.95Lakhs. 

 

Also under the FAQ sections of ITR forms in Income tax site, ITR 2's Don't section says 

"This Return Form should not be used by an Individual or a Hindu Undivided Family whose Total Income for assessment year 2014-15 includes Income from Business or Profession"

 

 

Exempt income means income which is exempt from Tax i.e. PPF interest, Dividend income etc.

Also, additional money which you are earning it not your professional earning i.e. you are solely not engaged in that business right? I am saying where you are wholly employed by some company and this additional income is your other source income. So you can show it under other sources.

Your concerm must be 194J is TDS for Professional Services and your vendor is deducting TDS right? It is a professional service but in your case its not your primary profession so I think you can file ITR-1.

Alternatively, If you want to show the same as your professional earning than you have to file form ITR-4S where you have to show profits over 8% i.e. in your case entire amount of receipts which you have earned.

Yes, my vendors are deducting TDS (under 194J) and thats not my primary profession nor I'm employed to them. This is only a additional income that I get from my free time and I don't do this as a business. 

 

So just to double confirm, ITR1 is right for me ? 

You just file ITR-4 it is best, because u having professional receipts 
 

File ITR 4.. It doesn't matter if the profession is not a regular one.

ITR4s can be filed in quick file itr for having one time income of Rs.30000 for IT related service tds deducted in Sec 194C Rs.520 can we claim refund

Could you please guide, I only have sales service income from 3rd party company Rs.561174/- in FY14-15 and they had deduct 10% Tax under 194J also I earn bank interest of Rs.21649/- and tax deducted under 194A. 

I don't have any other income or source therefoe please guide me which form I have to filled in my returen. I have only 2 option in my ITR login i.e ITR-1 & ITR-4S.

Please guide.

ITR 4S not applicable. Since the TDS is deducted u/s 194J, your income may be from professional services and presumptive taxation is not applicable for professionals.

Hence ITR 4 to be filed.

Thanks, I don't have ITR 4 drop down menu in my IT log-in ID. Please guide how to proceed in such case @ Online.

Only option available is ITR1 & 4S

Thanks, As I mentioned in my quiries I provides Business development service to IT company in my own capacity, so do you still suggest me to fille the ITR4 in place of ITR1. If so then please guide which code I should follow under Nature of business Code 7(i) as well as other related sheet to be filled.
