No, you cannot get benefits u/s 89 if employer don't give 10E form. 10E is mandatory

Employer do not give 10E. You have to file it.

Yes Form is required to be filed by you, not by employer

Form 10E will be filed by the employee who is claiming relief u/s 89 against the arrear salary received for the earlier periods. 

If the form is noyt filed then you will not be eligible to claim the relief.
