Excise Duty

Dear All,

We have registered as manufacturers of excisable goods in excise department.. we are received finished products from our parental company ( Imports ),  the import invoice is in our name.  The same material will be delivered  our customers as sales. Now the question is for this sales Excise duty  applicable or not.

When you have recd/ import  material is contain all type of duty. now you are saleing these materials to your coustomers . now you should pass on duty to your coustomers. so material cost lable  will maintain. if you Duty part will be forword to coustomers.

in case the import invoice is in your name, you can not despatch the imported material direct to your customer unless you document the. you could have sold this under High seas sale but this should have happened prior to the material touches the India customs border. if the material has been cleared from customs you have to raise a local invoice and charge VAT or CST as applicable. since you are a manufecture please check   VAT registration certificate whether you are allow to sell  imported raw material without processing or adding value addition..

For trading activity no excise duty is required tobe paid. However if the cusomter wishes to have the duty credit then you would have tobe registered as a dealer under central excise to pass on the same.
